Processing of Personal Data

1. Informational Visit to Our Website

Every time our website is accessed, our system automatically collects data (so-called server log files) and information from the computer system of the accessing device. The following data is collected in this process:

  • Website visited
  • Date and time of access
  • Amount of data sent in bytes
  • Source/link from which you accessed the page (referrer URL)
  • Browser used
  • Operating system used
  • IP address used
  • Request details and destination address

This data is not combined with other data sources.

The data is stored in log files to ensure the website functions properly. In addition, the data helps us optimize the website and ensure the security of our IT systems. The data is not analyzed for marketing purposes in this context. The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session.

The legal basis for the temporary storage of the data and log files is Article 6(1)(f) of the DSGVO. We have a legitimate interest pursuant to Article 6(1)(f) of the DSGVO in optimizing our website.

2. Use of Cookies

The website uses so-called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Cookies serve to make our website more user-friendly, effective, and secure. Cookies are small text files that are stored on your computer and saved by your browser.

Our site uses both session cookies and persistent cookies. Session cookies are temporary cookies that are stored in the user’s web browser until the browser window is closed, at which point the session cookies are deleted. Persistent cookies are used for repeat visits and are stored in the user’s browser for a specific period of time (typically up to one year, in some cases two years). 3. Data Processing When Contacting Us via the Website

If you contact us via email (e.g., using the email address provided on our website), by phone, or by mail, the personal data you provide (e.g., name, email address, mailing address, etc.) will be processed to respond to your inquiry. If you contact us via the contact form provided on our website, you consent to the processing of your personal data. The processing of the personal data (title, first name, last name, company, phone number, email address, type of inquiry, your message) from the input form serves solely to process your contact request. Processing is carried out in accordance with Art. 6(1)(a) and (f) of the DSGVO. If the registration relates to the performance of a contract or pre-contractual measures, processing is carried out in accordance with Art. 6(1)(b) of the DSGVO.

Sources

We receive personal data from our contractual partners in the course of our business relationships. In addition, we process personal data that we receive directly from our customers, intermediaries, service providers, employees, and applicants. Furthermore, we process—to the extent necessary for the provision of a service—personal data that we have lawfully received from other group companies or other third parties (e.g., SCHUFA, Creditreform) (e.g., for the performance of services, the fulfillment of contracts, or based on consent you have provided). Furthermore, we process personal data that we have lawfully obtained from publicly accessible sources (e.g., debtor directories, land registers, commercial and association registers, the press, media, and the Internet) and are permitted to process.

Purposes of Processing and Legal Bases

We process your personal data in accordance with Article 6 of the EU DSGVO, namely pursuant to Article 6(1)(a) in cases of consent, Article 6(1)(b) of the DSGVO for the performance of a contract, Article 6(1)(c) of the DSGVO to comply with a legal obligation, Article 6(1)(d) of the DSGVO in cases of vital interests of the data subjects, and Article 6(1)(f) of the DSGVO in cases of a legitimate interest of our company or a third party. In addition, we process your personal data in accordance with the Federal Data Protection Act.

Disclosure of Personal Data

We will not disclose your personal data to third parties unless you consent to the disclosure, there is a legal obligation to disclose it, it is necessary for the performance of a contract, or we can rely on legitimate interests in the economic and effective operation of our business regarding such disclosure.

Within the Garbe Group, we share data internally to the extent that there is a legitimate interest pursuant to Article 6(1)(f) of the DSGVO in such internal sharing.

External service providers have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored by us. Recipients of personal data may include, for example: banks, advertising agencies, PR agencies, credit bureaus, payroll agencies, lawyers, IT service providers, professional associations, and government agencies (such as tax authorities, courts, public prosecutors, and the police).

Transfer of Personal Data

Data will only be transferred to countries outside the EU or the EEA (so-called third countries) to the extent that this is necessary to fulfill your orders, required by law (e.g., tax reporting obligations), you have given us your consent, or within the scope of commissioned data processing.

Where a transfer to a third country takes place, the personal data is protected in each case by one of the mechanisms described in Art. 44 et seq. of the DSGVO (adequacy decisions or appropriate or suitable safeguards).

Use of Analytics Tools, Plug-ins, and Tracking

1. Social Media Plug-ins

Our Websites use so-called social media plug-ins from the following social networks. After clicking on the embedded text/image link, you will be redirected to the respective provider’s page. Only after the redirection is user information transmitted to the respective provider, and information about you is collected by the respective network. With the help of this solution, you can determine for yourself whether and when data is transmitted to the operators of the respective social networks.

You can disable interest-based advertising via the cookie settings (see Section 4 (2)). If you are logged into your user account on the respective network during this process, the network operator may, if applicable, associate the information collected during that specific visit with your personal account. If you wish to prevent the collected information from being associated with your user account, you must log out of the social network before clicking on the graphic. Additionally, you have the option to configure your respective user account accordingly.

2. Other Plug-Ins and Embedded Features and Content

On our website, we use functional and content elements that are obtained from the servers of the respective providers (hereinafter “third-party providers”). These may include, for example, graphics, videos, or maps (hereinafter collectively referred to as “content”).

An adequate level of data protection when using service providers and processors outside the European Union (EU/EEA) is ensured through compliance with Art. 44 et seq. of the DSGVO.

YouTube

Our website uses plugins from the Google-operated site YouTube. The operator of the site is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

When you visit one of our pages equipped with a YouTube plugin, a connection to YouTube’s servers is established. In doing so, the YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to directly associate your browsing behavior with your personal profile. You can prevent this by logging out of your YouTube account.

The use of YouTube is in the interest of presenting our online offerings in an appealing manner, provided that you have consented to the use of the plugins and thus on the basis of Art. 6(1)(a) DSGVO.

We only track the extent to which the YouTube videos embedded on our site are viewed and delete this data after two years.

3. Analytics Tools

(a) Google Analytics

We use Google Analytics, a web analytics service provided by Google Ireland Ltd., Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, California 94043 (hereinafter “Google”). Google Analytics uses cookies to identify the frequency of use of certain areas of our website and user preferences. The information generated by the cookies regarding your use of our website (including your truncated IP address) is transmitted to a Google server in the United States and stored there. Google will use this information to evaluate your use of our website, to compile reports on website activity for us, and to provide other services related to website activity and internet usage.

We use Google Analytics only with IP anonymization enabled. This means that the IP address of users is truncated by Google within member states of the European Union (EU) or in other signatory states to the Agreement on the European Economic Area (EEA). Only in exceptional cases is the full IP address transmitted to a Google server in the United States and truncated there. The IP address transmitted by your web browser is not combined with other data held by Google. If you do not wish to have your activity analyzed or your reach measured by Google Analytics, you can, as an alternative to the options described in Section 4(2), specifically disable the use of Google Analytics cookies by installing a browser add-on. (b) Google Ads

(aa). We use the online advertising program “Google Ads” on our website and, within this framework, conversion tracking (visit action analysis). Google Conversion Tracking is an analytics service provided by Google Ireland Ltd., Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, California 94043 (hereinafter “Google”).

If you consent to the use of this service, a cookie for conversion tracking will be stored on your computer when you click on an ad placed by Google. These cookies have a limited validity period, do not contain any personal data, and therefore do not serve to identify you personally. If you visit certain pages on our website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to that page. Each Google Ads customer receives a different cookie. Therefore, it is not possible for cookies to be tracked across the websites of Ads customers. The information collected using the conversion cookie is used to generate conversion statistics. Your data may be transferred to the United States.

(bb). We use the remarketing feature within the Google Ads service on our website (see paragraph (a)).

To do this, user interaction on our website is analyzed—for example, which offers the user was interested in—so that we can display targeted advertising to users on other sites even after they have visited our website. For this purpose, Google stores a number in the browsers of users who visit certain Google services or websites in the Google Display Network. This number, referred to as a “cookie,” is used to track these users’ visits. This number serves to uniquely identify a web browser on a specific device and not to identify a person; personal data is not stored.

(d) LinkedIn Insight

We use the LinkedIn Insights Tag from the social network LinkedIn on our website, which is operated by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, California 94043, USA (LinkedIn).

LinkedIn Insights is a JavaScript code embedded on our website. It tracks visits by LinkedIn members to our website. LinkedIn receives information that you have visited our website and links this to your profile data on LinkedIn to display targeted advertisements about our company to you on LinkedIn. This allows us to measure the performance of our ads.

If you consent to the use of this service (see Section 4 (2)), a so-called cookie is stored on your device. If you subsequently log in to LinkedIn or are logged in to LinkedIn while visiting our website, your visit to our website is noted in your LinkedIn profile. For us, the data collected about you in this way is anonymous. It does not allow us to draw any conclusions about you. However, we would like to point out that this data is also stored and processed by LinkedIn, making it possible to link it to the respective user profile. Social Media

We maintain a corporate presence on the social network LinkedIn.

We cannot track which user data the social networks collect. We have no influence over the data processing that takes place for this purpose, cannot prevent it, and do not have access to the underlying data. We also do not have full access to your profile data. We can only see the public information on your profile. You determine the specific public information in your settings on the social network.

We receive anonymous statistics (e.g., followers) from the social networks regarding the use of our company page. The legal basis for the transfer of your data within the respective social networks is your consent, which may be revoked at any time without formalities, Art. 6(1)(a) DSGVO. The legal basis for the use of statistical data is Art. 6(1)(f) DSGVO. We cannot link the statistical data to the profile data of our visitors.

We receive your personal data via social networks when you actively provide it to us via a private message. We use your data (e.g., first name, last name, username, email address) to respond to your inquiry. Your data will be stored until this purpose is fulfilled. The legal basis for processing when you actively contact us is your consent within the meaning of Art. 6(1)(a) DSGVO. If your message relates to a (pre-)contractual relationship with us, the legal basis for data processing is Art. 6(1)(b) DSGVO.

To the extent that we receive personal data from you via a social network, the processing of this data is carried out under joint responsibility with the respective social network.

Processing and Storage Period

    • To receive the personal data you have provided to us in a structured, commonly used, and machine-readable format and to request its transmission to another controller, Art. 20 DSGVO;
    • To withdraw the consent you have given to us, Art. 21 DSGVO. If you object, we will no longer process your personal data in the future. This does not apply if processing is permitted on the basis of other provisions (e.g., Art. 6(1)(1) et seq. DSGVO).
    • In the case of an automated decision (profiling), the right to present your point of view and to contest the decision, Art. 22(3) DSGVO;
